Convenience store clerk Jefferson Bilbrey is free on $80,000 bond on a charge of second-degree murder for the March 10 shooting death of Richard Huddleston outside the Shell Market at 197 Haywood Lane.

Bilbrey, 45, confronted Huddleston, 22, who was in the process of stealing beer and ball caps inside the market. Huddleston ran to a car near the gas pumps. Bilbrey followed and fired his .38-caliber revolver twice at Huddleston as he was getting into the car. Huddleston, who was not armed, was fatally wounded in the upper body.

Bilbrey did have a valid handgun carry permit; however, the police department’s investigation, along with reviews by the District Attorney’s office and the grand jury, determined that his use of deadly force was not justified under the circumstances.

This was not the first time Bilbrey fired his pistol on market property. On September 23, 2006, Bilbrey reported that he was taking trash to a dumpster when a tractor-trailer came close to striking him. Bilbrey fired one shot at the truck. The rig kept going and traveled onto the interstate.
